ArastaLink Distance Service Contract (B2C)

This Distance Service Contract ("Contract") is a public offer by DERELİ TEKSTİL DIŞ TİCARET LİMİTED ŞİRKETİ ("ArastaLink") to consumers. It becomes binding for a specific order when you confirm your payment obligation (e.g., by clicking "Pay", "Place Order", or equivalent) and/or when your payment is successfully received for that order.

This Contract applies only to consumers (natural persons) acting for non-commercial purposes.

1. Parties

Service Provider: DERELİ TEKSTİL DIŞ TİCARET LİMİTED ŞİRKETİ ("ArastaLink"), Istanbul, Turkey.

Consumer: You, a natural person acting for non-commercial purposes.

2. Definitions

Account: your ArastaLink account or the order interface through which you submit requests, approve costs, and make payments.

Item: a product you ask ArastaLink to purchase, identified by a link and specifications you provide.

Order: the set of Items and associated services requested and paid for by you.

Commission: ArastaLink's fixed purchasing commission disclosed before payment.

Approved Price Limit: a limit you set that determines whether ArastaLink may purchase an Item if the seller's current price changes.

3. Subject of the Contract

ArastaLink provides a distance service consisting of: checking availability, purchasing Items on your instruction as a commission service, receiving and handling Items, providing photo reports, packaging/consolidation, and arranging international shipment with tracking where available.

ArastaLink does not manufacture Items and is not responsible for third-party sellers' stock levels, price changes, or internal policies.

4. Contract formation and Pre-Information

Before you confirm any payment obligation, ArastaLink provides you with the Pre-Information Form (Pre-Info). You must confirm receipt of the Pre-Info as part of the checkout/order process.

5. Order process

5.1. You submit an Order request by providing Item links/specifications and delivery details.

5.2. ArastaLink checks availability and current pricing and presents a payable amount and/or a clear calculation method.

5.3. You approve and pay.

5.4. After payment, ArastaLink proceeds with purchasing and service performance.

ArastaLink is not required to purchase Items until payment is received, unless expressly agreed otherwise in writing.

6. Pricing, fees, and transparency

6.1. The total payable amount for an Order consists of (as applicable): product cost, ArastaLink Commission, shipping/delivery costs, and any disclosed additional costs.

6.2. ArastaLink does not charge hidden fees. Any additional cost requiring your payment obligation will be presented for your explicit approval.

7. Price changes and Approved Price Limit

7.1. If the seller's current price is within your Approved Price Limit, ArastaLink may purchase without further confirmation.

7.2. If the seller's current price exceeds your Approved Price Limit, ArastaLink will request your approval. If you do not approve within a reasonable time, ArastaLink will treat the Item as not approved and proceed under Section 11 (refund for non-purchased items).

8. Basic quality check and photo report

ArastaLink performs a basic visual check and provides photos before international shipment. This is a limited check and does not constitute a full inspection or a warranty that the Item is free of hidden defects.

If an obvious issue is identified before shipping, ArastaLink will notify you and, where reasonably feasible, attempt to resolve it with the seller, subject to seller policy and practical constraints.

9. Shipping, customs, and prohibited items

9.1. Shipment method and delivery times depend on carrier availability and destination country procedures. Timelines are estimates.

9.2. You are responsible for compliance with import rules in your destination country and for paying any duties/taxes/fees charged by destination authorities or carriers.

9.3. ArastaLink may refuse to purchase, store, or ship prohibited or restricted Items under applicable laws, carrier rules, or internal compliance policies. If refusal occurs before purchase, Section 11 applies.

10. Consumer withdrawal and cancellations

10.1 General right of withdrawal

You may have a 14-day right of withdrawal in accordance with mandatory Turkish consumer rules.

For service contracts, the withdrawal period generally starts on the date the Contract is concluded for the relevant Order.

10.2 Express request to start performance

By paying and requesting purchase/shipping, you expressly request ArastaLink to start performing the services immediately.

If you withdraw after performance has started, you acknowledge that:

  • you may be required to pay for services performed up to the withdrawal date, and
  • non-recoverable third-party costs incurred for your Order may be deducted from refunds where permitted by mandatory law.

10.3 How to withdraw

To withdraw, you must send an unambiguous written notice identifying the Order:

11. Refunds

11.1 Items not purchased - refund within 24 hours

If ArastaLink confirms that an Item cannot be purchased (e.g., out of stock, seller refusal, price exceeds Approved Price Limit and you do not approve), ArastaLink will refund the amount paid for that Item within 24 hours from confirmation, excluding only non-recoverable costs clearly disclosed to you in advance (if any).

11.2 Withdrawal refunds

Where a withdrawal refund is due under mandatory law, ArastaLink will process refunds without undue delay and in any event within the statutory timeframe. Refunds are made using the same payment instrument used for payment unless you expressly agree otherwise.

11.3 Seller refunds and pass-through

If an Item has already been purchased and a return/cancellation is accepted by the seller, the refund depends on the seller's actual refund and timing. ArastaLink will pass through the refundable amount after receipt, deducting:

  • the Commission for purchasing services already performed (if applicable), and
  • non-recoverable handling/shipping costs already incurred for the Order (if applicable and permissible).

12. Liability

12.1. ArastaLink is not liable for delays or failures caused by third-party sellers, carriers, customs/authorities, or events beyond ArastaLink's reasonable control.

12.2. Nothing in this Contract excludes or limits liability that cannot be excluded under mandatory law.

13. Compliance and verification

ArastaLink may request additional information to prevent fraud and comply with legal obligations. ArastaLink may refuse or pause performance if compliance requirements are not met.

14. Personal data

Personal data is processed under our Privacy Notice (KVKK) and Cookie Policy published on the Site.

15. Governing law and disputes

This Contract is governed by the laws of the Republic of Türkiye.

Where applicable, disputes may be brought before the competent Consumer Arbitration Committee or Consumer Courts in Türkiye, subject to mandatory rules (including mandatory mediation where required by law).
